Terms of Service

This Terms of Service Agreement (the "Agreement") is entered into between Garry Marshall ("Bot Owner") and you, the user ("User"), of the LastSeen Discord bot (the "Bot").

By adding or using the Bot, you agree to be bound by this Agreement and by Discord's Terms of Service and Community Guidelines. If you do not agree, you should immediately discontinue use of the Bot. You must be at least 13 years old, and old enough to use Discord in your country, to use the Bot.

1. Use of the Bot: The Bot Owner grants the User a non-exclusive, non-transferable, revocable, limited license to use the Bot for personal or non-commercial purposes.
2. Prohibited Use: The User may not use the Bot in any way that violates applicable laws, rules, or regulations, that infringes upon the rights of any third party, or that abuses, disrupts, or attempts to gain unauthorized access to the Bot or its infrastructure. The User may not use the Bot for any commercial purposes without the express written consent of the Bot Owner.
3. No Warranty: The Bot is provided "as is" and "as available", without warranties of any kind, whether express or implied. The Bot Owner does not guarantee that the Bot will be uninterrupted, error-free, secure, or available at any particular time.
4. Limitation of Liability: To the maximum extent permitted by law, the Bot Owner shall not be liable for any damages arising out of the use or inability to use the Bot, including but not limited to, damages for loss of profits, loss of data, or other intangible losses.
5. Modifications to the Bot: The Bot Owner may modify, suspend, or discontinue the Bot at any time without notice. The User agrees that the Bot Owner shall not be liable to the User or any third party for any modification, suspension, or discontinuance of the Bot.
6. Intellectual Property: The Bot and all intellectual property rights therein are and shall remain the property of the Bot Owner. The User agrees not to copy, modify, or distribute the Bot or any portion thereof without the express written consent of the Bot Owner.
7. Indemnification: The User agrees to indemnify and hold harmless the Bot Owner from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of the User's use of the Bot.
8. Termination: This Agreement may be terminated by either party at any time for any reason. Upon termination, the User must immediately cease all use of the Bot. Provisions that by their nature should survive termination — including Intellectual Property, No Warranty, Limitation of Liability, and Indemnification — will continue to apply.
9. Changes to these Terms: The Bot Owner may update this Agreement from time to time. The updated Agreement will be posted on this website, and continued use of the Bot after the changes take effect constitutes acceptance of the revised Agreement.
10. Governing Law: This Agreement is governed by and construed in accordance with the laws of Belgium, without regard to its conflict-of-law provisions. Where you use the Bot as a consumer, this does not deprive you of the protection afforded by the mandatory laws of your country of residence.
11. Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or representations, whether written or oral, relating to the Bot.

By using the Bot, the User acknowledges that they have read this Agreement, understand it, and agree to be bound by its terms and conditions.
